Privacy statement
Verpact (previously Stichting Afvalfonds Verpakkingen) is strongly committed to the protection of your personal data and transparency in this regard. This Privacy statement describes how Verpact, as ‘controller’, collects, shares, uses and/or otherwise processes data which is related to you or which identifies you (hereafter: “personal data”), all in accordance with the General Data Protection Regulation (GDPR). Verpact processes personal data only where and to the extent that a legal basis exists, such as your consent, the performance of an agreement, a legal obligation or a legitimate interest.

Personal data and purposes for processing
Packtool & Packaging Waste Management Fee
Verpact processes personal data as required for notification and declaration of the Packaging Waste Management Fee. For this reason, on behalf of your company, via the Verpact website you must sign up for a Packtool account which you can use for notification and declaration of the Waste Management Fee.
In the context of registration, declarations and payments of the Packaging Waste Management Fee, as well as communication about such, Verpact can process the following personal data: first name and surname, gender, (business and/or mobile) phone number and e-mail address.
The processing of this personal data is necessary for the performance of the Packaging Waste Management Fee Agreement and to comply with legal obligations incumbent on Verpact.
Contact & customer service
Via the Verpact website, you can also ask questions to Verpact employees (by e-mail or phone). In this context, Verpact processes your name, e-mail address and/or telephone number and any mail correspondence concerning the question and any communication in that connection.
In our e-mail communications, we make use of a so-called tracking pixel. This is a small, invisible image included in HTML e-mails. This enables us to receive technical information, such as:
- whether and when an e-mail has been opened;
- the type of e-mail application or device used to open it;
- any interactions with links in the e-mail.
We use this information exclusively to analyse and improve the effectiveness of our communications. You can limit the use of tracking pixels by disabling the automatic loading of images in your e-mail application.
Newsletter
You can also use your e-mail address to subscribe to our newsletter. In this context, Verpact can process your name, e-mail address and technical data relating to the sending and opening of newsletters. The processing of your personal data for the purpose of sending the newsletter takes place exclusively on the basis of your consent, which you may withdraw at any time by unsubscribing via a link in the corresponding e-mail.
Website and cookies
During your visit to Verpact’s website, we also store the Internet Protocol (IP) address of your computer, and type of operating system, Internet browser and pages visited, by placing functional or limited analytical cookies. Cookies are small text files placed on your computer or mobile device when you visit our website.
This technical information is used to manage and secure the website and to be able to provide you with website functionalities and, for example, resolve technical faults or improve accessibility of certain parts of the website. These cookies have no or minimal impact on your privacy. For this reason, we do not require your consent to place these cookies.
We also make use of:
- Preference cookies, which enable our website to remember information that affects the behaviour and appearance of the website;
- Reporting cookies, which provide us with insight into overall visitor behaviour on our website, enabling us to improve the user experience;
- Marketing and advertising cookies, which allow us to measure results so that we can advertise more effectively. We never share customer data with third parties.
When you visit the Verpact website, you will have the opportunity to choose your cookie settings and disable optional cookies via the cookie banner settings. You may also be able to adjust your browser settings to manage cookies. Please note that deleting or disabling certain cookies may affect your user experience and that parts of the website may no longer be fully functional.
Retention periods
Verpact will not store your personal data for any longer than for the purpose for which personal data was collected, or not longer than what is authorised by law or necessary for the conduct of any legal proceedings.
Verpact shall retain the personal data processed in the context of the Packaging Waste Management Fee for the period necessary to fulfil obligations arising from the Packaging Waste Management Fee Agreement (ABBO).
For personal data processed in connection with your participation in promotional prize draws, Verpact retains your personal data for up to one year after your last participation.
If you have unsubscribed from our newsletters via opt-out, or have withdrawn your consent for other processing activities, we will delete the relevant personal data as quickly as reasonably possible. The aforesaid technical data such as the IP address and the browser data of your computer will not be retained for longer than 1 month.
Who has access to your data?
In order to provide our services, we may share your data with other organisations. We do not share more personal data than is strictly necessary for the purpose for which it is processed.
Verpact will only share your personal data with third parties, provided this is necessary for carrying out its service (e.g., hosting of the website, software management, financial administration, handling of complaints), or in so far as Verpact is obliged to do so by law (e.g., in relation to supervisory authorities and bodies such as the Dutch Tax and Customs Administration). A processor agreement is concluded with companies processing personal data for Verpact (‘processors’), such as parties supporting our marketing activities where you have given your consent to the extent required, or offering promotional prize draws, in order to ensure careful use and the appropriate level of security and confidentiality of the data. Verpact remains responsible for these processing operations. As a rule, personal data is only processed within the European Economic Area.
Automated decision-making
Verpact does not make use of automated decision-making, including profiling.
Security of personal data
Your personal data is treated as confidential and Verpact has in place appropriate technical and organisational security measures for optimum protection of your data against misuse, loss or unlawful processing. To this end, Verpact uses a variety of security technologies, including secure servers, firewalls and encryption, as well as physical security of rooms in which data is stored.
In addition, we restrict access to your personal data to those employees, representatives, contractors and other third parties who necessarily need to view such data. They will only process your personal data in accordance with our instructions and are bound by a duty of confidentiality. Risk analyses are conducted on a regular basis and new technological developments and threats are assessed. We also test the functioning of our information security framework on an ongoing basis.

Our privacy and cookie statement does not apply to personal data which is collected and processed from you or via these external websites.
Your rights
You have the right to request access to, amendment of, restriction of, erasure of, or transfer of your personal data. Via the Packtool account, you can also do this yourself in part via the personal settings. You also have the right to retract your permission for certain data processing or to oppose the processing of your personal data.
If you wish to exercise your legal rights or if you have any other questions/comments about the processing and/or protection of your personal data by Verpact, please send a specific request to info@Verpact.nl or Verpact, Postbus 13799, 2501 ET The Hague. We will reply as soon as possible to your request and at any rate within one month. In order to comply with your exercise of legal rights, we may, where necessary, request additional information to verify your identity.
Verpact would also like to point out that you have the option to lodge a complaint to the national regulator, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), P.O. Box 93374, 2509 AJ The Hague.
Applicable law
This Privacy statement, as well as all disputes arising from or associated with this Privacy statement, are subject exclusively to the law of the Netherlands.
Changes
We reserve the right to modify this Privacy statement in order to guarantee conformity with the applicable legislation and regulations. It is advisable to refer to this Privacy statement at regular intervals so that you are up to date with any changes.
