Conformity  

All producers and importers must demonstrate that their packaging complies with all the rules set out in the PPWR through a Declaration of Conformity.

  • The Manufacturer assesses whether the packaging meets the PPWR obligations by means of a conformity assessment and then draws up a Declaration of Conformity. This declaration, including a list of the materials (including weight) present in the packaging, must be available for submission to the Human Environment and Transport Inspectorate upon request. Suppliers are obliged to provide the relevant data.
  • Distributors and retailers are required to check whether the packaging they import/purchase is provided with a Declaration of Conformity.  

The rules for conformity assessment are set out in Appendix VII of the PPWR, and include:

  • Description of the packaging and its intended use. 
  • Design drawings. 
  • Materials used (including weight). 
  • Standards/norms used (if applicable). 
  • Description of how the requirements in Articles 6 (recyclability), 10 (minimisation) and 11 (reusability) have been met.   

Declaration  

From 2026, declaring will be mandatory for everyone who meets the criteria of the definition of Producer. As regards transport packaging, service packaging and primary production packaging, this is the company that is the first to make empty, unfilled or stacked packaging available in a country. The responsibility for the declaration of transport packaging and primary production packaging therefore shifts from the party who fills it to the person who produces the packaging (this was already the case for service packaging). Exception: when another party has the packaging produced in his name or under his brand. In that case, the client is both the manufacturer and the producer. 

As from 12 August 2027, a producer register must have been established in which producers must register and report as well. For producers affiliated with Verpact, Verpact will take over the registration and reporting. Registration is possible from the establishment of the register. The first year of reporting is expected to be 2028 (to be reported before 1 June 2029). 

Specific rules apply regarding reporting in the producer register. The packaging administration is divided into 22 different packaging types, plus any SUP packaging, returnable packaging and reusable packaging, under which weights must be indicated (split by material).  As a result, the number of packaging types for which we will have to submit requests will be much greater than 22.  

Smaller companies (< 10,000 kg of packaging on the market per year) do not have to declare packaging categories but only provide an overview of the weight of the materials used.   

The current packaging administration will be expanded with at least: 

  • The RPG, also as evidence and available for inspection by the Human Environment and Transport Inspectorate. 
  • The weight of all individually used materials.
